Terms of Use for Digital Subscription – Myanmar Now Ltd

Myanmar Now was founded in 2015 and has since become a leading provider of news and information about Myanmar. We are an independent outlet committed to covering a range of issues affecting the country, its people, and the world it interacts with.  

Currently focussed on the ongoing civil war, we seek to provide insight into the multiple crises unleashed by the military’s attempt to consolidate control after seizing power in February 2021. We examine all aspects of the conflict, including abuses by anti-regime forces, while placing the current situation within the context of Myanmar’s struggle to overcome the legacy of half a century of disastrous military rule. 

These Terms of Use (“Agreement”) govern your use of the digital subscription services (“Services”) and materials (“Materials”) provided by Myanmar Now Ltd (“Myanmar Now,” “we,” “us,” or “our”) through its website (“Website”). By accessing or using the Services, you agree to comply with the Terms of Use listed on this webpage. Please read these terms carefully.  

We comply with the fundamental principles of journalism. You can view our Code of Conduct below.  

1. Subscription Agreement: 

a. Subscription: By purchasing a digital subscription, you gain unlimited access to all Materials published on the English-language Website of Myanmar Now for the duration of your subscription period. Your subscription will be renewed automatically unless you cancel it. If you would prefer to cancel your subscription, you are free to do so before the end of the direct debit/credit card billing cycle. 

We reserve the right to modify the content, inclusions, type, and availability of any Materials at any time. We also reserve the right to enable free access to part or all of our Website for periods of time and you will not be eligible for a full or partial refund of your subscription fees if we do this. Further to this, we reserve the right to share paywalled Materials and content for publication via other outlets, including those that are free access, and you will not be eligible for a full or partial refund of your subscription fees if we do this. 

b. Fees and Payments: You agree to pay the subscription fees as indicated on the Website. Fees are inclusive of any applicable taxes.  

‘Due to the unique complexity, volatility, and unpredictability of the reporting situation in Myanmar, you will not be eligible for a refund or credit of any nature if, for reasons outside of our control, you lose access to our Website or related material for any period of time, or we are unable to publish new Materials to the Website for any period of time.’ 

Although we will do our best to provide constant, uninterrupted access to the Website, we do not guarantee this, and accept no responsibility for any unavailability, interruption, or delay. As a human rights-focused publication operating under a dictatorial military regime, Myanmar Now operates in a uniquely challenging reporting environment. We appreciate your patience and understanding in consideration of this. 

We charge in United States dollars and you agree to pay the subscription price at the payment intervals stated at the time you order your subscription. We can change our pricing and fees at any time. We will give you at least 14 days’ notice if the new price is greater than the price you received at the commencement of your subscription. If you have a fixed-term subscription, the new price will be shown in your renewal notice. If you have an auto-renew subscription, the new price will be notified to you by email. For auto-renew subscriptions, the new price won’t apply until your next billing date after the notice. 

2. Access and Use: 

a. Access Rights: Your subscription grants you a non-exclusive, non-transferable right to access and use the English-language Websites for personal, non-commercial purposes for the duration of your subscription period. 

b. User Accounts: You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately of any unauthorized use of your account. 

3. Content: 

a. Usage Restrictions: You may not reproduce, distribute, modify, copy, adapt, or otherwise exploit any Materials or content provided through the Website unless expressly permitted by Myanmar Now Ltd. You may retrieve Material for personal, non-commercial purposes only. 

You must not:  

  • modify any Material without Myanmar Now Ltd.’s written permission; 
  • remove any copyright, trade mark, or other proprietary notices from the Material; 
  • engage in any activity that could mislead or deceive a person into believing that the Material is from a source other than the Website, including embedding, deep-linking, or framing the Material without Myanmar Now Ltd.’s consent. 

b. Copyright: All content provided through the Website is protected by copyright and other intellectual property laws. You may not remove or alter any copyright notices or other proprietary rights notices. 

4. Privacy: 

a. Data Collection: We collect and process personal information in accordance with our Privacy Policy, which is incorporated into this Agreement by reference. Any personal information supplied to Myanmar Now in the registration process (including your name and email address) will be used and disclosed in accordance with our Privacy Policy.  

5. Termination: 

a. Termination: We reserve the right to suspend and/or terminate your access to any part of the Services, for any reason (including a breach of these Terms of Service) or may prevent your use of the Services with or without notice to you.  You agree that Myanmar Now Ltd has no liability to you if the Services are discontinued or your ability to access them is terminated.  

6. Consumer Guarantees: 

a. Statutory Rights: Nothing in this Agreement excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (ACL) or any other applicable law. 

7. Limitation of Liability: 

a. No Warranty: The Services are provided on an “as is” and “as available” basis. We do not warrant that the Services will be uninterrupted, error-free, or free from harmful components, and make no claims nor representations as to the content or suitability of the information on the Services or for any other purpose.  

b. Limitation of Liability: To the extent permitted by law, we will not be liable for any loss or damages caused as a result of your doing, or not doing, anything as a result of viewing the Website and related Materials, or any part thereof. You can access other sites via links from the Website. These sites are not under our control and we are not responsible in any way for any of their contents. 

We give no warranties of any kind concerning the Website or Materials. In particular, we do not warrant that the Website or any of its contents is virus free. You must take your own precautions in this respect as we accept no responsibility for any infection by virus or other contamination or by anything which has destructive properties. 

8. Governing Law and Jurisdiction: 

a. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Australia. 

9. Changes to the Agreement: 

a. Amendments: We may modify this Agreement from time to time. Changes will be effective upon posting to the Website. Your continued use of the Services after any changes indicates your acceptance of the modified Agreement.
