In unprecedented move among ASEAN members, Timor-Leste opens war crimes case against Myanmar

The Chin Human Rights Organisation announced on Tuesday that Timor-Leste’s judicial authorities have initiated proceedings against Myanmar, a fellow member of the Association of Southeast Asian Nations (ASEAN), for alleged atrocities, the first instance of such an act among the regional bloc’s members. Some two weeks after the CHRO—which monitors human rights violations in Myanmar’s northwestern Chin State—filed a criminal complaint in Timor-Leste’s capital of Dili, a senior Timorese prosecutor has been appointed to review the material, according to the group. “This is a significant step toward justice for the Chin people and all people in Myanmar,” said Salai Za Uk, CHRO’s executive director, referring to ethnic communities inhabiting Myanmar’s northwestern Chin State. He added that he welcomed the prosecutor’s appointment and expressed a deep sense of “solidarity” with Timor-Leste, a country whose own history was shaped by a long struggle for independence. Timor-Leste has taken up the case amid widespread international condemnation of a recent election held in Myanmar, which critics have called a “sham”, pointing to low turnout, the the dissolution of viable opposition parties, and the Myanmar military’s close management of the vote. Myanmar’s fellow ASEAN members did not send observers or otherwise aid in implementing the election in ways that might confer legitimacy on the process. The third and final phase of the election occurred just a week before the fifth anniversary of the coup in which Myanmar’s military overthrew a duly elected civilian government in 2021. The United Nations has described the military’s attempts to exert authority in the country since the takeover as a “reign of terror.” According to UN estimates, the junta now securely controls little more than 40 percent of the country’s area and has lost large stretches of territory along Myanmar’s international borders to anti-junta armed groups. Jose Teixeira of Da Silva Teixeira & Associados, the Timorese law firm representing CHRO, said the case underscores Timor-Leste’s commitment to the rule of law and judicial independence. “It is vital that the legal process runs its course without any outside interference, particularly from the Myanmar junta,” he said. The complaint submitted to prosecutors contains what CHRO and its legal partners describe as extensive evidence of grievous abuses. These included the alleged killings of civilians and a journalist, the gang rape of a pregnant woman, attacks on religious figures, and an airstrike on a hospital that reportedly killed medical staff and patients. The dossier also documents attacks on churches and civilian infrastructure, which are protected from the use of military force under international law. Chris Gunness, director of the group Myanmar Accountability Project, which supports legal cases against Myanmar’s military, called the proceedings “a significant milestone on the Burmese people’s long march to justice.” “The road ahead will be fraught with obstacles,” he said. “But this case sends a powerful signal that accountability is an indispensable part of the struggle against dictatorship and tyranny.” Timor-Leste joined ASEAN in 2022 after years of forging strong ties with the bloc’s other members. Legal experts say the newly opened case could test regional norms of non-interference, as well as the scope of national courts’ authority to prosecute offenders for violations of international law beyond their borders. Neither Myanmar’s military authorities nor ASEAN officials have publicly commented on the proceedings at the time of reporting.
